Advertising may be defined as a passive form of promotion via printed or audio-visual media. It is the central symbol of the consumer society, so that it is hardly surprising that regulation of advertising raises fundamental questions concerning the objectives and techniques of consumer protection. In the UK, activities of advertisers are limited by private law rules, regulatory prohibition and business self-regulation. Self-regulation is a primary instrument of the regulation of advertising. The most important controls on advertising and sales promotion can be found in the system of self-regulation based on the British Codes of Advertising and Sales Promotion. EU law also regulates the area of advertising. The regulation of advertising is mainly covered by the Consumer Protection from Unfair Trading Regulations 2008, that implement almost all respects, simply copying out provisions of the EC The Unfair Commercial Practices Directive 2005/29/EC. And of course, Private Law brings remedies for misleading advertising either through misrepresentation or breach of a contract term. Some rules that developed at common law like principles of the Law of Tort relating to defamation, malicious falsehood and passing off and some statutory rules relating to copyright and designs and patents and trademarks also limit the activities of advertisers.

Reklamcılık, basılı, işitsel veya görsel yollarla yapılan pasif promosyon olarak tanımlanabilir. Günümüz tüketim toplumunun temel sembollerinden biri olmalarından dolayı, reklamlar hakkındaki yasal düzenlemelerin, tüketicilerin korunması yöntemleri ve hedeflerine ilişkin önemli sorunlara yol açmaları şaşırtıcı değildir. Birleşik Krallık’da, reklamcıların faaliyetleri, özel hukuk kuralları, mevzuat hükümleri ve sektörün öz düzenlemeleri ile sınırlandırılmaktadır. Hatta sektör öz düzenlemelerinin, reklamların yasal çerçevesinin çizilmesindeki birincil araç olduğu söylenebilir. Reklamlar ve satış promosyonları üzerindeki en önemli kontroller, öz denetim sistemine dayanan İngiliz Reklam ve Satış Promosyonları Kodu’nda bulunur. Avrupa Birliği Hukuku da, reklamcılık alanında yasal düzenlemeler getirmiştir. Söz konusu düzenlemeler esas olarak Tüketicileri Hukuka Aykırı Ticari İşlemlerden Koruma Regulasyonları 2008 ile ortaya konumuştur. Birleşik Krallık’da yürürlükte olan bu regulasyonlar, Avrupa Birliği Hukuka Aykırı Ticari Uygulamalar Direktifinin 2005/29/EC, neredeyse tüm hükümlerinin herhangi bir değişikliğe uğratılmaksızın aynen kabul edilmesi şeklinde hazırlanmıştır. Bütün bunların yanısıra, özel hukuk alanında da, aldatıcı reklamlara ilişkin düzenlemeler bulunmaktadır. Aldatıcı reklamlara ya gerçeğe aykırı beyan ya da sözleşmeye aykırılık nedenlerinden ötürü çeşitli yaptırımlar getirilmiştir. Özel hukuk alanında geliştirilen, haksız fiil hukukuna ait hakaret, hile, dolandırıcılığın yasaklanmasına ilişkin kurallar, telif hakkının dizayn ve patent ve markaların korunması yönündeki kurallar, reklamcıların faaliyetlerini sınırlandırmaktadır.

As advertising is an important symbol of the consumer society, regulation of deceptive and unfair advertising practices has strong connection with consumer protection1. Activities of advertisers are limited by private law rules, regulatory prohibition and business self-regulation in the UK.

Certain types of advertising are considered as unfair because they exploit human weakness or vulnerable groups, debase tastes or use sexual and racial stereotypes2. Advertising controls must cope with instances of half-truth, ambiguity, undue emphasis, dishonesty and exaggeration. They must examine the total impression created by the advertisement3.

In the United Kingdom self-regulation is a primary instrument of the regulation of advertising. Perhaps the most important controls on advertising and sales promotion can be found in the system of self-regulation based on the British Codes of Advertising and Sales Promotion4. The self-regulatory system for advertisements other than on television or radio, began in the early 1960s when the Advertising Association drew up a Code of Advertising Practice (CAP)5. In 1959, The Molony Committee was set up to consider and report on changes to consumer law, According to Molony Committee6, advertisements which make a false or misleading claim should be regulated by trade descriptions legislation7. Also the Committee opined that the consumer is “everybody all of the time”8. Later on, Advertising Standards Authority (ASA) became more important in controlling deceptive and unfair advertising9.
