An Innovative Step On Electronic Justice Among European Judicial Systems
Avrupa Yargı Sistemleri Arasında E-Adalet’in Gerçekleştirilmesine Yönelik Yenilikçi Bir Adım

The main reproduction tools have always a significant role in terms of shaping the social order rules. Humanity, that passed the primitive, agricultural and industrial society stages depending on the nature of the main production tools which provide fundamental needs, is now having information society stage. In other words, today the main production tool of humankind is “information” and the innovative/intellectual creativeness of the information technology. The rapid improvements in the information and communication technologies make it possible to supply all human needs in a faster, easier and cheaper way. The functioning of justice services is also a part of this process and there are ongoing researchs and projects to reach the most effective and productive services of the judicial systems in all contemporary world. In this brief study, the research and innovations of the use of ICT among European judicial systems will be shown with an historical context by giving a special reference to the National Judicial Network Project carried out in Turkish legal system.

İnsanlık tarihi boyunca, temel üretim araçları toplumsal düzen kurallarının şekillenmesinde çok önemli bir yer tutmuştur. İnsan ihtiyaçlarının karşılanmasını sağlayan temel üretim araçlarının özelliklerine bağlı olarak ilkel toplum, tarım toplumu ve sanayi toplumu aşamalarından geçen insanlık, bugün bilgi toplumu aşamasını yaşamaktadır. Diğer bir ifadeyle, günümüzde temel üretim aracı, bilgi ve o bilgi teknolojisini üreten insan beyninin yaratıcılığıdır. Bilgi teknolojilerindeki hızlı gelişmeler, bilgi toplumu olma yolunda, hayatın her alanındaki insan ihtiyaçlarının çok daha hızlı, kolay ve ucuz bir biçimde karşılanmasını sağlamaktadır. Adalet hizmetlerinin yürütülmesi de bu durumda bağımsız değildir ve modern dünyada yargı sistemlerinin en etkin ve verimli şekilde hizmet verebilmesi için, bilgi ve iletişim teknolojilerinden azami ölçüde faydalanmayı sağlamak üzere (E-Adalet) çalışmaları yürütülmektedir. Bu çalışmada, Avrupa yargı sistemlerinde bu alanda yaşanan gelişmeler tarihsel boyutuyla ortaya konularak, özellikle Türk yargı düzeninde faaliyete geçirilen Ulusal Yargı Ağı Projesi (UYAP) kapsamında yapılan çalışmalarla paralel olarak ele alınacaktır.

Introduction
The improvement of the administration of justice system is always a significant problem and endless discussions have been made on reducing the length of judicial proceedings, improving the transparency, efficiency and effectiveness and promoting confidence in the justice system. In this respect, the rapid development of information and communication technologies (ICT) has opened up new and different opportunities to improve the administration of the entire justice system. The availability of web services, the use of electronic signature and filing, the exchange of electronic data including legal documents are new examples which were unthinkable only a few decades ago1. These developments of ICT has led the judicial administrations to rethink and - if possible to redesign - their functions and activities all around the world.
The Turkish National Judicial Network Project (NJNP) is emerged from such an innovative process in combination with a consistent reform of the legal framework and of the structure of the judicial organisation. The Project establishes an electronic network which connects all the institutions in the justice sector (including all Courts, Offices of Public Prosecutors, Detention and Penitentiary Houses, Forensic Institutions and Enforcement Offices together with the Central organisation of the Ministry of Justice). In this short study, this ambitious judicial ICT innovation will be discussed in details to provide comparative information on the strategical use of ICT innovation in other European judicial systems.
