The Necessity of Justification of the Criminal Court’s Decisions and Discussions of Unarmed Terrorist Organization (In the Light of Hizb-ut Tahrir Decision)

Bu çalışmada; genel olarak ceza mahkemesi kararlarının gerekçeli olmasının adil yargılanma hakkı kapsamında değerlendirmesi yapılacaktır. Bu bağlamda, Anayasa Mahkemesi’nin 26.10.2018 tarih ve 30577 sayılı Resmi Gazete’de yayımlanan 2014/13117 numaralı bireysel başvuru kararı (Hizb-ut Tahrir) ışığında, “ceza mahkemesi kararlarının gerekçeli olması ve adil yargılanma hakkı arasındaki ilişki” üzerinde durulacaktır. Bununla beraber inceleme konusu yargılama kararlarının temelinde “silahsız terör örgütü” tartışmaları bulunduğundan çalışmada, maddi ceza hukuku boyutuyla örgüt suçlarına da değinilecektir. Maddi ceza hukuku bakımından özellikle üzerinde durulacak konu ise, meri Türk mevzuatına göre “silahsız terör örgütü” kavramı olacaktır. Çalışmada ilk olarak, inceleme konusu bireysel başvuru kararına temel teşkil eden yargı kararlarına kısaca değinilecek ve uyuşmazlığa konu olaylar genel hatlarıyla açıklanacaktır. Bu kapsamda, ilk derece mahkemelerinin ve Yargıtay’ın konuya ilişkin vermiş olduğu kararlar kısaca özetlenecektir. Sonrasında, Anayasa Mahkemesi’nin somut olaya yaklaşımı ve konuya ilişkin görüşleri üzerinde ayrıntılı olarak durulacaktır. Akabinde, çalışmanın bütünlüğünün sağlanabilmesi açısından Türk ceza mevzuatındaki örgüt suçlarına ilişkin düzenlemeler üzerinde durulacaktır. Bu kapsamda; suç örgütü, silahlı örgüt ve terör örgütü suçları kısaca açıklanacaktır. Böylece çalışmamızın ve dolayısıyla da söz konusu uyuşmazlığın esasını oluşturan “silahsız terör örgütü konusu” meri mevzuatımız açısından açıklığa kavuşturulacaktır. Bunun için suç örgütü kavramına ve bu kavramın kriminoloji ve maddi ceza hukuku bakımından türlerine ilişkin kısa değerlendirmeler yapılacaktır. Bir başka ifadeyle bu kısımda, Türk ceza mevzuatı bakımından “silahsız terör örgütünden” bahsedilip bahsedilemeyeceği tartışma konusu yapılacaktır. Maddi ceza hukukuna ilişkin bu değerlendirmelerin akabinde tartışmaya açılacak esas konu ise, “ceza mahkemesi kararlarının yeterli gerekçeye sahip olmamasının ceza muhakemesi hukuku ve adil yargılanma hakkı bağlamında ortaya çıkardığı sonuçlar ve sorunlar” olacaktır. Çalışmanın hukuki değerlendirme ve görüşümüz başlıklı kısmında ise, özellikle çalışmamızın başlığını da oluşturan ceza mahkemesi kararlarının yeterli ve tatmin edici gerekçeye sahip olması zorunluluğu üzerinde durulacaktır. Özetle bu çalışmada; meri Türk mevzuatı açısından “silahsız terör örgütü” suçundan bahsedilip bahsedilemeyeceği ile savunma makamının ısrarla ileri sürdüğü ve hükmün esasını etkileyecek nitelikteki iddialara yargılama makamının yeterli cevap vermeden hüküm kurması halinin “adil yargılanma hakkı” bağlamında değerlendirmesi yapılacaktır.

The need for justification of criminal court decisions will be assessed in this study within the context of “the right to a fair trial”. Within this framework, the relationship between the necessity of justification and the right to a fair trial will be discussed in light of the Turkish Constitutional Court’s individual application decision (Hizb-ut Tahrir) No. 2014/13117, which was published in the Turkish Official Gazette on October 26, 2018, and numbered 30577. The legal problems that need to be resolved on the subject are related to both the substantive criminal law and the penal procedure law. In this context, the first problems to be solved are what the regulations regarding organized crimes in Turkish criminal law mean, and the relationship between them. As “unarmed terrorist organization discussions” underpin the matter, this section will also focus on the concept of “unarmed terrorist organization”. The relationship between the 220th and 314th articles of the Turkish Penal Code (TPC) numbered 5237, and the provisions of the Anti-Terrorism Law numbered 3713 must be clarified in order for the subject to be placed on a correct legal basis. In this respect, first af all, it should be examined whether an element of “being armed” is needed for an organization to be considered a “terrorist organization”. The second legal problem that needs to be resolved is related to the criminal procedure law. The link between the “necessity of justification the criminal court’s decisions” and the “right to a fair trial”, which is a constitutional right, appears to be a legal problem that must be overcome in terms of procedural law. Shortly, in this study, it will be discussed whether the right to a fair trial is violated if the judicial authority does not respond adequately to the defense’s claims that affect the merits of the judgment and convicts the person concerned.

The need for justification of criminal court decisions will be assessed in this study within the context of “the right to a fair trial”. Within this framework, the relationship between the necessity of justification and the right to a fair trial will be discussed in light of the Turkish Constitutional Court’s individual application decision (Hizb-ut Tahrir) No. 2014/13117, which was published in the Turkish Official Gazette on October 26, 2018, and numbered 30577.
Since the “unarmed terrorist organization discussions” constitute the basis of the dispute in question, criminal organizations will be briefly explained from the point of Turkish criminal law. In this regard, the point to be emphasized will be the concept of “unarmed terrorist organization”.
In this context, the judicial decisions that constitute the basis for the individual application decision in question will be briefly mentioned, and the events subject to the dispute will be described in general terms. In addition, the decisions of the trial courts and the Supreme Court on the issue will also be summarized. Following that, the Turkish Constitutional Court’s approach to the specific case and its views on the issue will be discussed in detail.
Subsequently, Turkish penal legislation related to organized crime will be tackled. “Criminal organization crimes (Turkish Penal Code (TPC) article 220)”, “armed organization crimes (TPC article 314)”, and “terrorist organization crimes (Turkish Anti-Terror Law Number 3713, article 7)” will be discussed in this context. Legal judgments and opinions on the subject will also be presented in the legal assessment section, which is the basis of our study.
In this context, brief evaluations will be made on the concept of a criminal organization and its types in terms of criminological and substantive criminal law. In other words, it will be a matter of discussion whether an “unarmed terrorist organization” can be mentioned in terms of Turkish criminal law. After these brief assessments related to criminal law, the main issue that needs to be discussed is “the consequences of the lack of sufficient justification of the criminal court decisions in the context of criminal procedure law and the right to a fair trial”.
