Avrupa İnsan Hakları Mahkemesinde (AİHM) 45036/98 başvuru numarasıyla görülen davası 30 Haziran 2005’te Büyük Dairenin kararı ile sonuçlanmıştır. Bu metin söz konusu kararın İngilizce metninden yapılan çeviridir. davası Avrupa İnsan Hakları Sözleşmesi’ne (AİHS) taraf olan devletlerin başka uluslararası antlaşmalara taraf veya uluslararası örgütlere üye olmaktan kaynaklanan yükümlülüklerini yerine getirirken Sözleşme’den doğan yükümlülüklerini ihlal edip etmediklerinin AİHM tarafından denetlendiği davalardan biridir. Davanın esası iki hukuki sorunun ele alınmasını içermektedir: Birincisi uyuşmazlık konusu müdahalenin İrlanda makamlarına atfedilebilirliğine bağlı olarak mahkemenin yargılama yetkisine sahip olup olmadığı, ikincisi de yargılama yetkisinin tespit edilmesinden sonra mülkiyet hakkının İrlanda Devleti’nce ihlal edilip edilmediğidir. İhlal değerlendirmesi mülkiyet hakkına ilişkin kararlarda olağan olan muhakeme sırasını izlemekte, fakat müdahalenin meşruiyetinin sorgulanmasına sıra geldiğinde, bu tür uyuşmazlıklarda gündeme gelen eşdeğer korumaya ilişkin doktrininin tartışmalı bir uygulamasını içermektedir. Sonuçta mahkeme başvurucu şirketin mülkiyet hakkı ihlaline ilişkin iddialarını iki temel gerekçeyle reddetmiştir. Birincisi müdahalenin İrlanda’nın uygulamaktan kaçınamayacağı bir Avrupa Topluluğu tüzüğüne dayanması, ikincisi de Topluluğun AİHS sistemine eşdeğer insan hakları koruması sağlamasıdır. Mahkemenin iki tespiti de öğretide eleştirilmiş olup kararın Türkçe çevirisi bu tür davalar hakkında yapılacak yeni çalışmalara katkı sağlayabilecektir.

The case before the European Court of Human Rights (application no. 45036/98) was finalized by the Grand Chamber judgment delivered on the 30th of June 2005. The presented text is a translation of the judgment from the English text. case is one of those cases in which the Court reviews whether a state party to the European Convention on Human Rights violates its obligations under the Convention while fulfilling obligations arising from other conventions or organisations that it is a party to or a member of. Merits of the case includes the examination of two legal issues: First one is whether the Court has jurisdiction in relation to the issue of attributability of the disputed interference to the Irish authorities, and having determined the jurisdiction, the second issue is whether the Irish state had violated the right to property. The assessment on the violation follows the usual order of consideration for judgments regarding the right to property, but when it comes to the examination of the legitimacy of the interference, the assessment involves a controversial application of the doctrine regarding the equivalent protection, which comes into question in such cases. In conclusion, the Court rejects the claims made by the applicant company on the right to property essentially on two grounds: Firstly, according to the Court, the interference was based on a European Community regulation that Ireland could not have abstained from execution, and secondly the Community had provided an equivalent protection of human rights to that of the Convention system. Both findings having been criticized by scholars, the Turkish translation of the judgment might be a contribution to the prospective studies regarding such cases.
