Abstract: The Turkish Constitutional Court decided on two constitutional complaints about two journalists, Şahin Alpay and Mehmet Altan. Although the TCC had found the violations of right to liberty and security and freedom of expression, the Courts of Assize had refused to release Mr. Alpay and Mr. Altan with various reasons. Thereafter, the European Court of Human Rights (ECtHR) decided on two individual applications about the same journalists as the TCC decided. In the context of Şahin Alpay v. Turkey judgment, I would like to summarize the facts and process concerning detained journalist Mr. Alpay and emphasize some points, which I thought that the judgment would fall short of in Turkey.

Özet: Anayasa Mahkemesi, gazeteci Şahin Alpay ve Mehmet Altan’ın anayasa şikâyeti başvuruları neticesinde iki ayrı ihlal kararı vermiştir. AYM, ifade özgürlüğü ile kişi özgürlüğü ve güvenliğinin ihlaline karar vermesine rağmen, Ağır Ceza Mahkemeleri çeşitli gerekçelerle başvurucuların tahliye taleplerini reddetmiştir. Daha sonra İnsan Hakları Avrupa Mahkemesi AYM’nin verdiği kararlara benzer şekilde başvurucuların ifade özgürlüğü ile kişi özgürlüğü ve güvenliği haklarının ihlal edildiğine karar vermiştir. Bu çalışma kapsamında da tutuklu gazeteci Şahin Alpay ile ilgili olarak süreç özetlenecek ve kararın beklentileri karşılayamayan noktaları vurgulanacaktır.

On 11 January 2018, the Turkish Constitutional Court (TCC) decided on two constitutional complaints about two journalists, Şahin Alpay and Mehmet Altan1 These were the TCC’s first judgments concerning detained journalists since the attempted coup of July 2016. Despite some deficiencies in these judgments, it is possible to say that the TCC showed progressive approach with these judgments after the attempted coup of July 2016. The TCC held that there had been violations of Article 19, Article 26 and Article 28, which is related to right to liberty and security and freedom of expression of the Constitution. Although the TCC had found a violation of right to liberty and security under Article 19 paragraph 3 of the Turkish Constitution, the Courts of Assize had refused to release Mr. Alpay and Mr. Altan.

Afterwards, the TCC made the second judgment of constitutional complaints on Mr. Alpay to be released by the Court of Assize 5 days ago from the ECtHR’s judgments2 . On 15 March, the TCC issued a second ruling in Alpay’s case, reiterating its first judgment. This time, the Court of Assize abided by the TCC’s competence. So, Mr. Alpay was released from prison on 17 March, but he was placed under indefinite house arrest. As for Mr. Altan, he is being reheard after the judgment given by the appeal court. On 20 March 2018, the European Court of Human Rights (ECtHR) decided on two individual applications about the same journalists3 . The ECtHR endorsed the TCC’s findings.

I would like to summarize the facts and process concerning detained journalist Mr. Alpay after the attempted military coup and emphasize some points, which I thought that the judgment would fall short of in Turkey.
